1. Acceptance of Terms & Legal Capacity

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Customer," "you," or "your") and Moskey Technologies ("Company," "we," "us," or "our"), governing your access to and use of Moskey CMS (accessible at moskey.in/cms), our associated websites, APIs, mobile interfaces, and digital subscription services.

By registering an account, clicking "Sign Up", purchasing a subscription, or using the services, you confirm that you are at least 18 years of age (or have reached the age of majority in your jurisdiction) and have the full legal capacity and corporate authority to enter into these Terms. If you do not agree to these Terms, you must not access or use the platform.

2. Scope of Services & Platform Capabilities

Moskey CMS is a cloud-based Software-as-a-Service (SaaS) platform designed for digital content creators, marketing agencies, and media enterprises. Key capabilities include:

• Unified multi-platform video and image publishing across YouTube (Shorts & Long-form), Meta (Facebook Pages & Instagram Reels/Feed), Threads, LinkedIn, Discord, TikTok, and Twitter/X.
• Generative AI captioning, hashtag generation, and social copywriting tools.
• Consolidated social analytics, engagement metrics, and channel audience insights.
• Direct multi-channel media transcoding and Cloudflare R2 cloud storage pipelines.

You acknowledge that actual content dispatch is subject to the external availability, rate limits, and operational uptime of third-party social media APIs.

3. Commercial Plans, Pricing, Taxes & Billing Terms

Moskey CMS offers both free tier options and paid subscription plans (such as Pro Creator and Agency Business tiers), as well as pay-as-you-go credit packs.

Your rights regarding cancellations, money-back guarantees, and digital service rectifications are comprehensively governed by our dedicated policies:

• Cancellations: You may cancel your subscription at any time without fee or penalty via your account dashboard or by emailing support@moskey.in. Access continues through the end of the paid billing cycle.
• 7-Day Money-Back Guarantee: First-time paid subscribers are protected by our 7-day money-back guarantee, as detailed in our Refund and Cancellation Policy.
• Digital Returns: Because our services are intangible and delivered electronically, physical product returns are not applicable, as explained in our Return Policy.
• Refund Timelines: Approved refunds are initiated within 2–3 business days and credited to the original payment source (via PhonePe) within 5–7 business days.

When creating and operating a Moskey CMS account:

• You agree to provide accurate, current, and complete registration details.
• You are strictly responsible for maintaining the confidentiality of your credentials and all activities occurring under your account.
• You must notify Moskey Technologies immediately at support@moskey.in upon discovering any unauthorized use or security breach.
• You warrant that you possess all necessary rights, licenses, and releases for all media content uploaded or scheduled through Moskey CMS.

7. Third-Party Platform Terms & Developer Policies

Moskey CMS integrates with multiple social media networks. By connecting your accounts, you explicitly agree to comply with the respective policies of each connected provider:

• YouTube Terms of Service and Google Privacy Policy.
• Meta Platform Terms & Instagram Commercial Terms.
• TikTok Terms of Service.
• LinkedIn User Agreement.
• Discord Developer Terms of Service.
• X (Twitter) Developer Agreement.

8. Intellectual Property Rights & Content Ownership

Your Content: You retain 100% of your ownership, copyright, and intellectual property rights in all videos, images, copy, audio, and metadata uploaded to Moskey CMS. You grant Moskey Technologies only a limited, non-exclusive, worldwide license solely to transcode, store, and transmit your media to your designated social accounts upon your explicit instruction.

Platform IP: All proprietary software, code, algorithms, user interfaces, branding, trademarks, and documentation comprising Moskey CMS remain the exclusive intellectual property of Moskey Technologies and its licensors.

9. Prohibited Conduct & Acceptable Use

You agree not to use Moskey CMS to:

• Upload or broadcast content that infringes any copyright, patent, trademark, or trade secret.
• Distribute unlawful, defamatory, harassing, sexually explicit, hate speech, or terrorist content.
• Engage in coordinated spamming, automated bot traffic, or artificial manipulation of social platform metrics.
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of Moskey CMS.
• Circumvent rate limits, access controls, or security architecture.

10. Disclaimer of Warranties & Limitation of Liability

Moskey CMS is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Moskey Technologies does not guarantee uninterrupted, error-free, or secure platform operation, or that social networks will accept or index published content without delay.

To the maximum extent permitted by applicable Indian law, Moskey Technologies, its founders, officers, and employees shall not be liable for any indirect, incidental, punitive, or consequential damages, loss of revenue, profits, or third-party social account suspensions. In all events, the maximum aggregate liability of Moskey Technologies arising out of or related to these Terms shall not exceed the total amount actually paid by you for Moskey CMS services in the three (3) months immediately preceding the claim, or INR ₹1,000, whichever is less.

11. Governing Law & Dispute Resolution

These Terms, their interpretation, and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed strictly in accordance with the substantive laws of the Republic of India, without regard to conflict of law principles.

You and Moskey Technologies irrevocably agree that the competent courts situated in Ranchi, Jharkhand, India shall have exclusive subject-matter and territorial jurisdiction over any claim, suit, or legal proceeding arising out of or related to these Terms or the services provided.
